High Court of Delhi vs Devina Sharma

Bench: 3 — D.Y. Chandrachud

In Brief

The Supreme Court addressed challenges to age requirements for Delhi's judicial service recruitment examinations. The Court held that while the Constitution mandates only a seven-year legal practice requirement for district judge appointment, High Courts possess rule-making authority to prescribe minimum and maximum age limits as matters of policy. The Court allowed as a one-time measure candidates who would have qualified for the 32-year-old upper limit in DJS (2020-2021) and 45-year-old limit in DHJS (2020-2021) to apply in 2022, given examinations were not conducted during those years. The 35-year minimum age requirement for DHJS, conforming to Shetty Commission recommendations, was upheld as constitutionally valid. Appeals were partly allowed with revised examination schedules.
