Hill View Colony and others challenged a High Court order that granted a writ petition by Industrial Village Razhuphe directing cancellation of census records collected by the Dimapur Municipal Council. The appellants, who were not original parties to the writ petition but sought to challenge it on appeal, were not given an opportunity to file counter affidavits. The Supreme Court held that where leave to appeal is granted to non-parties, they acquire locus standi and must be heard before final adjudication. The Court set aside the High Court orders and remanded the writ petition for fresh decision by the Single Judge after granting all parties, including the new appellants, full opportunity to file pleadings and counter affidavits."
