The High Court had fixed monthly charges at Rs. 1,35,800, significantly higher than the original contractual rent of Rs. 5,000 per month. The Supreme Court, without deciding the matter on its merits, invoked its extraordinary power under Article 142 of the Constitution to settle the dispute finally. The Court fixed a lump-sum payment of Rs. 30 Lakhs as full and final settlement of all use and occupation charges, allowing the appellant to deduct tax at source and requiring payment within one month, thereby avoiding prolonged litigation."
