While trial and appellate courts upheld the Gift Deed's validity and the appellant's title, the High Court dismissed the suit merely because the appellant had not challenged the subsequent sale deed. The Supreme Court held that a declaration of title effectively operates as a declaration that inconsistent documents do not bind the plaintiff, making a separate cancellation suit unnecessary for non-parties to the document.
