The Supreme Court dismissed an appeal by a real estate promoter challenging a consumer commission order on refund rights. The Court affirmed that under Section 18 of the Real Estate (Regulation and Development) Act, 2016, if a promoter fails to deliver an apartment by the agreed date, the allottee has an unqualified right to withdraw and demand full refund of the amount paid, plus interest at the prescribed rate. This right exists "without prejudice to any other remedy" and the allottee need not justify the withdrawal decision. The refund remedy is automatic and independent of the promoter's circumstances.
