In Brief
The Supreme Court constituted a Constitution Bench to resolve conflicting interpretations of sections 24(1) and (2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Multiple related cases were referred, arising from disputes between the Indore Development Authority and landowners concerning land acquisition. The three-Judge Bench judgment in Indore Development Authority v. Shailendra and an earlier judgment in Pune Municipal Corporation had reached different conclusions. The Court determined that a Constitution Bench should comprehensively reconsider all conflicting positions and substantive issues before rendering a final decision. The matter was scheduled for substantive hearing after other pending constitutional matters.
