Interglobe Aviation challenged rules on aircraft disinfection by fumigation. During the hearing, the Union of India filed a counter-affidavit explaining its position. The Supreme Court found the core issue—whether fumigation disinfection is permissible—to be fundamentally a policy matter concerning public health. Rather than decide the issue itself, the Court directed the Union government to establish an expert committee to assess benefits and hazards, then make a reasoned policy decision.
