ITC Ltd vs Aashna Roy

Bench: 2 — Rajesh Bindal, Manmohan

In Brief

A woman alleged negligent haircutting at an ITC hotel salon damaged her hair and derailed her career in modelling and corporate jobs. She sought ₹5.2 crore compensation. The National Consumer Disputes Redressal Commission awarded ₹2 crore. The Supreme Court upheld the finding of faulty service but set aside the compensation award. The Court found that while the salon committed a breach of service, the respondent produced only unverified photocopies of documents to support claimed losses in modelling and job opportunities, without the original documents or credible proof of financial harm. Compensation must rest on solid evidence, not speculation. The Court limited the award to ₹2.5 crore already deposited earlier.
