In this criminal appeal, the Supreme Court examined whether a High Court's grant of bail to three murder convicts was justified. The accused had been convicted of murdering two men in 2011 and initially sought bail after serving over ten years. However, while the case was on trial, two of the accused—Chandra Kumar and Rishi Kumar—killed a police constable who was escorting them from court, then absconded and fired on police during arrest. The Court held that such serious subsequent conduct negated bail eligibility despite long incarceration. It cancelled bail for Chandra Kumar and Rishi Kumar but upheld bail for Arvind Kumar, as he was not involved in the constable's murder. The Court emphasized that grave conduct during trial must be considered in bail decisions.
