Jagdish and another were convicted under Sections 302, 148, and 149 of the IPC for murder during a criminal assault. The appellants challenged the conviction, arguing that since co-accused were acquitted, there was insufficient evidence of common intention and that the sole eye witness (PW-1) was highly unreliable. The Supreme Court found PW-1's testimony improbable on her own evidence and held that conviction cannot rest on such doubtful testimony alone. The Court allowed the appeal and acquitted the appellants.
