Jagdish vs State of Haryana

Bench: 2 — Abhay Manohar Sapre

In Brief

Jagdish was convicted by the trial court for causing the death of Zile Singh (under Section 304 Part II IPC) and simple hurt (under Section 323 IPC) during a street fight between two sets of relatives. The High Court upheld the conviction. Jagdish appealed to the Supreme Court, challenging the conviction and arguing that eyewitness evidence was unreliable and that absence of blood stains proved the incident did not occur. The Supreme Court held that the concurrent findings of two lower courts based on consistent eyewitness testimony cannot be set aside unless wholly arbitrary. Finding no arbitrariness and accepting the credible testimony of three eyewitnesses, the Court dismissed the appeal and cancelled bail, directing Jagdish to surrender to serve his sentence."
