Ex-servicemen appointed to Punjab Civil Service under vacancies advertised after enforcement of the 1982 Rules cannot claim military service credit for seniority based on the superseded 1972 Rules. Although the earlier rules governed the percentage of reserved vacancies (which originated before 1982), seniority determination is governed by the rules in force at the time of appointment. The omission of military service credit from the 1982 Rules meant it was no longer available. The saving clause did not extend to benefits not accrued before the new rules came into force. The Supreme Court upheld the High Court's dismissal of the writ petitions.
