The appellant, a construction company, challenged the High Court's dismissal of its writ petition against a tender award. The respondent Zilla Parishad had disqualified the respondent bidder (M/s L.D. Constructions) at the technical bid stage but later, after receiving a personal request, re-opened and re-evaluated the bids, declared the respondent eligible, and awarded it the contract. The Supreme Court held that this re-evaluation violated natural justice and fair procedure, as the disqualified tenderer was re-included without affording proper opportunities to other bidders. The Court set aside the High Court's order and directed the Zilla Parishad to process the matter afresh from before the corrigendum stage.
