Jasdeep Kaur Chadha vs State (NCT of Delhi) & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Jasdeep Kaur Chadha challenged a High Court order that barred the prosecution from confronting a witness with a statement made after the charge-sheet was filed. The Supreme Court held that Section 145 of the Indian Evidence Act permits confrontation with any previous statement in writing if relevant, without limiting it to statements made during investigation. The Court overruled State v. Mukesh as per incuriam and reaffirmed the binding principle from Tara Singh v. The State. The appeals were allowed and the High Court's order set aside.
