Jaspal Kaur Cheema and Anr vs Industrial Trade Links and Ors. etc

Bench: 2 — S. Abdul Nazeer

In Brief

The Supreme Court reversed the High Court's order allowing tenants to amend their written statement to dispute the landlord's ownership of an industrial shed in Chandigarh. The tenants had initially admitted the landlord's ownership through a lease deed and cross-examination, then sought to deny it later. The Court held that Section 116 of the Indian Evidence Act estops a tenant from denying the landlord's title during tenancy. Allowing such a late amendment would violate procedural rules requiring specific denial in original statements. The Rent Controller's rejection of the amendment application was upheld, and the eviction petition proceedings were restored.
