A man was charged with rape (IPC s. 376) and criminal intimidation (s. 506) after a consensual relationship with a married woman ended without him marrying her, despite his promise. The Sessions Court discharged him, finding the woman had given informed consent. The High Court set aside this discharge. The Supreme Court allowed the appeal, holding that a mere breach of a promise to marry does not constitute rape—only a false promise made from the outset with intent to deceive does. Since the woman was mature, aware of the consequences, and continued the relationship for years while married, the Court found insufficient material for conviction and terminated the proceedings.
