The Supreme Court considered appeals by landowners whose land was acquired for Jhajjar Thermal Power Plant. The High Court had awarded compensation at Rs. 16,00,000 per acre, the same as the original collector's award, rejecting the landowners' reliance on a prior Supreme Court judgment that had awarded Rs. 25,00,000 per acre for similarly situated land acquired for Arawali Power Company. The Court held that although the prior judgment contained a 'not precedent' caveat, it applied only to the evidentiary issue of post-notification sale deeds, not to property comparability. Finding the lands similarly situated, the Court enhanced compensation to Rs. 22,00,000 per acre, with restrictions on interest eligibility for certain delayed appeals."
