JASWANT SINGH vs JASPAL SINGH

Bench: 2 — N.V. Ramana, Mohan M. Shantanagoudar

In Brief

The plaintiff-respondent, residing abroad, authorised an agent to act on his behalf regarding suit property. He claimed a 1983 judgment holding certain defendants as property owners was obtained by collusion and was invalid. He had also sold the property via deed in 1984 before the judgment was registered. The Supreme Court upheld all three lower courts' findings that the 1983 judgment was indeed collusive and therefore void. The 1984 purchasers were confirmed as bona fide buyers for value. The appeal was dismissed, affirming the plaintiff's rights to the property.
