In Brief
This appeal challenged the 1980 land acquisition of the appellants' property in Haryana by the state government and Haryana Urban Development Authority. The appellants argued that subsequent notifications in 1990 and 1995 amounted to abandonment of the original acquisition, that procedural safeguards under Section 5A were violated, and that discrimination occurred since other lands in the same zone reserved for economically weaker sections had been released. The Supreme Court dismissed the appeals, holding that fresh notifications for different parcels do not constitute abandonment, that proper inquiry procedures were followed, and that land reserved for weaker sections cannot lawfully be released to the appellants even if they offered alternative benefits. The Court emphasized it cannot perpetuate illegality against weaker sections of society.
