Joint Registrar of Co-Operative Societies, (General) and etc. etc vs Cherian Eapen and Ors. etc. etc

Bench: 2 — Kurian

In Brief

This appeal concerns the interim management of a co-operative society following disputed elections held on 5 November 2016. The High Court had allowed the elections to proceed provisionally, subject to pending writ petitions challenging them under Section 69 of the Kerala Co-operative Societies Act. The Supreme Court upheld the election but restricted the elected Managing Committee to day-to-day administrative functions only, prohibiting policy decisions until the High Court resolved the underlying disputes. This allowed the society to continue essential operations while preserving all parties' contentions for final determination.
