George Elias and Associates sought to establish a Hot Mix Plant and obtained an Acknowledgement Certificate under the Kerala Micro Small and Medium Enterprises Facilitation Act, 2019, along with Pollution Control Board consent. The local Panchayat refused permission. The Supreme Court held that the Acknowledgement Certificate serves as an approval under the Act and, by Section 10, overrides the requirement for Panchayat permission under the Kerala Panchayat Raj Act, 1994. The Kerala MSME Act does not override environmental laws; pollution control remains governed by separate statutes. Once Consent to Establish is obtained, the statutory requirements are satisfied, and Panchayat permission is not required.
