Joseph Lukose & Ors vs Arvind Pundalik Tendulkar & Ors

Bench: 2 — Sanjay Kumar, Alok Aradhe

In Brief

Joseph Lukose and others filed a Transfer Petition to move a civil suit (Special Civil Suit No. 80 of 2017) pending in the Panvel court, Maharashtra, to the Ernakulam court in Kerala. The Supreme Court found that only respondent no. 1 was the contesting respondent, who consented to the transfer. The remaining respondents were proforma parties with no objection. Based on this mutual consent and the counsel's statements, the Court allowed the petition and ordered the case transferred to the Court of Sub-Judge, Ernakulam (Kerala)."
