In a Presidential reference under Article 317(1) of the Constitution, the Supreme Court examined whether Mepung Tadar Bage, Member of Arunachal Pradesh Public Service Commission, should be removed for misbehaviour following an alleged question paper leak in 2022. Finding no cogent evidence directly linking her to the incident or substantiating six vague charges against her, the Court held that removal is individual, not collective, and requires specific attribution of misconduct to the individual member. The Court ruled that institutional lapses alone do not constitute misbehaviour, revoked her suspension, and recommended restoration with full benefits.
