Jugut Ram was convicted of murder (Section 302 IPC) for assaulting the deceased on the head with a lathi during a land dispute, resulting in death the next day. The Supreme Court allowed his appeal, reducing the conviction to culpable homicide not amounting to murder (Section 304 Part II IPC). The Court found that the assault was spontaneous and unpremeditated with only two blows inflicted. Key factors were: the deceased did not die immediately, no evidence of premeditation, both parties suffered injuries, and the cumulative circumstances showed knowledge of likely death rather than intention to cause death. Having already undergone the maximum prescribed sentence since 2004, the appellant was released."
