K. Jayaram and others, sons of M. Krishna Reddy, challenged the allotment of sites formed in 8 guntas of land they claimed was not acquired by the Bangalore Development Authority in the Binnamangala layout. The Supreme Court dismissed the appeals, holding that the appellants suppressed material facts—they had filed an identical civil suit in 1999 which was dismissed by the trial court and rejected in appeal in 2003, but did not disclose this in their writ petition. On merits, the 8 guntas comprised kharab-B (waste) land included in the acquisition notification, and no separate compensation could be claimed.
