Supreme Court of India 2022-06-24 dismissed

K.M. Manjunath vs Erappa G. dead through Lrs

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court upheld the High Court's decision in a landlord-tenant ejectment case. The tenant held a property under successive yearly lease agreements for eleven-month periods. The trial court had dismissed the eviction suit, finding no valid termination of tenancy under Section 106 of the Transfer of Property Act. The High Court reversed this, holding that the lease terminated automatically by efflux of time under Section 111(a) and no statutory notice was required. The Supreme Court affirmed, granting the tenant six months to vacate subject to paying arrears of rent and monthly installments during the extended period.
