K.MARAPPAN (DEAD) THROUGH SOLE LR. BALASUBRAMANIAN vs THE SUPERINTENDING ENGINEER T.B.P.H.L.C. CIRCLE ANANTAPUR

Bench: 2 — Ashok Bhushan, K.M. Joseph

In Brief

K. Marappan, a contractor, appealed against a High Court judgment that had set aside most arbitration awards under irrigation contracts with the State. The Supreme Court upheld the dismissal of claims for non-supply of food grains, short supply of cement, and accumulated materials due to lack of supporting evidence and the contractor's failure to produce mandated documents. However, the Court partly allowed the appeal regarding the claim for extra lead (cost of transporting stone from a farther quarry), restoring the sub-Court's modified award. The Court also restored the arbitrator's award of interest pendente lite, finding that arbitrators have power to award such interest when contracts do not prohibit it.
