K.S. Rajan (D) through LRs vs State of Kerala & Anr

Bench: 2 — Abhay Manohar Sapre

In Brief

The appellant's land was acquired by Kerala in 1980 for a multipurpose development scheme. The Land Acquisition Officer initially valued wet land at Rs. 203 per cent, later increased by courts to Rs. 500 per cent. The appellant challenged this, arguing that other landowners' identical wet land in the same project was awarded Rs. 2,000 per cent. The Supreme Court agreed that similarly situated land acquired in the same proceeding should receive identical compensation. The Court enhanced wet land compensation to Rs. 2,000 per cent, finding this reflected proper market value. The appeal was allowed in part, and statutory compensation was awarded accordingly.
