K. Sivaraman & Ors vs P. Sathishkumar & Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

This case concerns the retrospective application of statutory amendments to workmen's compensation law. The appellants challenged compensation awarded by the High Court following a railway accident. The Supreme Court held that compensation entitlements are determined by the date of the accident, not the adjudication date. An amendment to the Employees' Compensation Act that deleted wage-capping provisions does not apply to accidents occurring before the amendment took effect. As the High Court's enhancement of compensation was not challenged by the benefiting party, the Supreme Court declined to interfere, dismissing the appeal.
