Supreme Court of India 2017-01-12 remanded

Kailash Vijayvargiya vs Antar Singh Darbar and Ors

Bench: 2 — Kurian

In Brief

This appeal challenged a High Court order directing inquiry under Section 340 of the Criminal Procedure Code based on alleged forgery and contradictory statements in an affidavit. The Supreme Court held that mere contradictory statements or allegations of forgery do not automatically justify initiating such an inquiry. The court must form a satisfaction that the inquiry is required in the interests of justice and is appropriate given the factual matrix and consequences of prosecution. Finding no such satisfaction, the Court set aside the order and remanded the matter to the High Court for fresh consideration in accordance with law.
