The High Court remanded the case to the appellate court, directing it to reconsider issues under the Act. The Supreme Court held that remand was unjustified since the appellate court had already properly examined all issues under the Act based on evidence. The Court restored the appellate judgment and allowed the appeal, upholding the decree for eviction, arrears of rent, and mesne profits with a three-month grace period for vacation subject to deposit of decreetal amounts."
