Kalvakuntla Kavitha, a former Member of Parliament and Member of Telangana Legislative Council, appealed against a High Court order denying her bail in a money-laundering case under the Prevention of Money-Laundering Act, 2002. The Supreme Court held that the proviso to Section 45(1), which provides special treatment to women in bail matters, is not limited to vulnerable women but extends to all women, including educated and accomplished ones. The High Court erred by denying her the statutory benefit solely based on her educational qualifications and social status. Since investigation was complete and she had been in custody for five months with trial unlikely to conclude soon, the Court allowed the appeal and granted bail on specified conditions.
