The Supreme Court held that a municipal corporation is competent to suspend and initiate departmental proceedings against an Additional Municipal Commissioner (AMC), even though the State Government created the post and appointed the officer. Reading sections 2(9), 39A, and 56 of the Maharashtra Municipal Corporations Act harmoniously, the Court found that once appointed, the AMC becomes a corporation employee subject to its disciplinary jurisdiction. The Court rejected the High Court's view that only the State Government could take such action, noting this would absurdly leave officers accused of misconduct untouchable. The suspension must be reported to the corporation with reasons and lapses after six months if not confirmed.
