KAMATCHI vs LAKSHMI NARAYANAN

Bench: 2 — Uday Umesh Lalit, Pamidighantam Sri Narasimha

In Brief

A woman filed an application under the Protection of Women from Domestic Violence Act, 2005 seeking protection orders against her husband and in-laws for alleged domestic violence spanning from 2007 to 2008. The High Court quashed proceedings against the in-laws but also quashed the proceedings against the husband, holding that the application was barred by a one-year limitation period under the Criminal Procedure Code. The Supreme Court held that applications under Section 12 of the Domestic Violence Act are not subject to the limitation period; limitation applies only to breaches of orders issued under the Act. The Court allowed the appeal, setting aside the High Court's judgment, and remitted the matter to the Magistrate for consideration on merits.
