Kamlesh was appointed as an Extra Departmental Employee at a Delhi post office on a provisional basis in 1992. The appointment order explicitly stated the appointment would end when a regular incumbent was appointed, and she had no claim to permanent employment. After 12 years of service, she sought regularization, but the Central Administrative Tribunal and High Court rejected her plea. The Supreme Court dismissed her appeal, holding that provisional appointments with such explicit terms do not confer regularization rights through length of service. However, she could continue in the position until regular appointment was made, without back wages.
