This appeal concerns whether a person claiming to be a co-owner of property is a necessary or proper party to an ejectment suit filed by other co-owners against tenants. The Supreme Court held that in an ejectment suit, only the landlord and tenant are necessary parties. A claimed co-owner cannot be compelled to join the suit. The suit can proceed and be decided on its merits—whether the landlord-tenant relationship exists and eviction grounds are established—without the co-claimant's presence. However, any findings on title made in the suit do not bind the non-party co-claimant, who remains free to pursue an independent suit for declaration of title and partition.
