Kannan vs State rep. by Inspector of Police

Bench: 2 — Banumathi

In Brief

Two government officials (Assistant Commercial Tax Officer M. Nadimuthu and Kannan) were convicted of demanding and accepting a bribe of Rs. 800 from a grocery shop owner to return a seized accounts book. The trial court sentenced both to two years imprisonment. The High Court upheld the conviction but reduced the sentence to one year. The Supreme Court dismissed their appeal, finding that the complainant's testimony was sufficiently corroborated by accompanying witnesses and confirmed by a chemical test turning red when exposed to sodium carbonate solution. The Court upheld concurrent findings of the lower courts.
