Kartik Chandra Majee and Ors vs State of Jharkhand and Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The appellants, including the father-in-law and relatives of a woman's husband, were accused of dowry harassment under Section 498A IPC. The complaint was filed years after the woman married the eldest son, who had already been publicly disowned by his father in 1999 through newspaper publication severing all family ties. The complaint contained only vague allegations and lacked specific charges. Notably, the woman later compromised the matter with her husband but continued prosecuting only the in-laws. The Supreme Court held that the proceedings were manifestly malicious and initiated solely to harass the appellants due to personal grudge over the son's disinheritance. Invoking its inherent power under Section 482 CrPC (Category 7 of the Bhajan Lal test), the Court quashed the entire criminal complaint and proceedings.
