The appellant, an Additional Assistant Engineer, was accused of obtaining a fake Scheduled Caste certificate to secure employment. The police sought court permission for DNA testing to prove his actual caste belonged to 'Telanga' rather than 'Yanadi'. The Supreme Court held that while police have the right to seek DNA testing permission, it was premature in this case as substantial investigation had not yet been completed. Allowing roving or fishing inquiries without foundational investigative work would be improper. The Court allowed the appeal, finding the police had jumped to conclusions too early in the investigation process.
