Kausalya Bhoi and Others vs Divisional Manager, Oriental Insurance Co. Ltd. And another

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Laxman Bhoi, riding a cycle, was fatally struck by a motorcycle in December 2014. His three surviving adult children sought compensation. The Motor Accident Claims Tribunal awarded Rs. 24,07,741/- with 6% interest. The High Court reduced this to Rs. 20,00,000/- without providing any reasons. The Supreme Court held that since both lower courts accepted the factual basis of the claim, the High Court's reduction was unjustified. Absent cogent reasoning, the Tribunal's assessment must stand. The Court set aside the High Court's order and restored the Tribunal's award."
