In Brief
In this appeal, Trend Vyapaar Ltd. sought modification of orders requiring payment of provident fund dues accumulated in the Kelvin Trust to be transferred to the Waverly Trust, along with statutory interest from June 1986. The Supreme Court dismissed the applications, holding that a final judgment affirmed by both the High Court and the Supreme Court cannot be recalled or modified in enforcement proceedings. The Court clarified that allegations of fraud must be pursued through review petitions in the High Court, not modification applications. However, the Court permitted such review petitions without delay objections if filed within 30 days, and directed transfer of the deposited Rs. 1.95 crores with accrued interest, subject to any High Court orders in review proceedings."
