Kempegowda Institute of Medical Sciences vs Medical Council of India and Ors

Bench: 3 — A.M. Khanwilkar

In Brief

A medical college sought a court order (mandamus) requiring the Medical Council of India to approve an increase in its MBBS intake seats from 120 to 150 for the 2017-18 academic year. The college had been found to have certain deficiencies during inspection. The Supreme Court declined the relief because the admission deadline for 2017-18 had already passed and the college had not yet rectified the identified deficiencies. The Court directed that the application be treated as made for 2018-19, ordered a fresh inspection within three months, and required the MCI to recommend the matter to the Central Government for final decision after hearing the college through the prescribed committee mechanism."
