Kim Wansoo, a foreign national serving as Project Manager for HEC India LLP, was named in an FIR regarding alleged default in payment of Rs. 9 crores by a sub-contractor (YSSS) to a complainant company (M/s R.T. Construction). The Supreme Court allowed his appeal, quashing the FIR and all proceedings against him. The Court held that the FIR contained only vague allegations with no specific charges against the appellant or his company. Since the allegations, even if accepted as true, did not constitute any offence against the appellant, and allowing the trial would amount to abuse of process, the extraordinary power under Article 226 should have been exercised to quash the FIR.
