The appellant, inducted as a tenant by the Wakf Board, challenged the High Court's order that set aside a Tribunal decision and restored her predecessor's tenancy rights. The plaintiff claimed hereditary tenancy as a joint Hindu family member, arguing that the Karta could not unilaterally surrender the tenancy. The Supreme Court held that a tenancy contract is an individual property right, not presumed to be joint family property based merely on rent payments or household headship on a Ration Card. Without evidence that the business was conducted with joint family funds or earnings, there is no presumption of joint family business. The Court allowed the appeal, restoring the Tribunal's judgment and the appellant's tenancy rights.
