Kiran Pal Singh, elected Pramukh of a Uttar Pradesh block panchayat, challenged a second no-confidence notice filed after a first notice had been received but no meeting held. He argued that under Section 15(12) of the State Panchayat Act, a one-year bar applies once any notice is given. The Supreme Court dismissed the appeal, holding that the one-year prohibition applies only after a meeting is actually convened and either the motion fails or quorum is lacking. Mere receipt of a notice does not trigger the bar. The Court also clarified that the Collector must only perform a summary check of statutory compliance, not investigate disputed factual claims.
