Supreme Court of India 2025-09-16 dismissed

Komal Krishan Arora & Ors vs Sandeep Kumar & Ors

Bench: 2 — J.K. Maheshwari, Vijay Bishnoi

In Brief

The Supreme Court dismissed an appeal by maternal grandparents and mother challenging a High Court order granting interim custody of a two-and-a-half-year-old boy ('Master K') to his father in a cross-border marital dispute. The boy was left in India by his mother, who had relocated to the UK with her daughter without informing the father. The Court emphasized the child's best interests as the paramount consideration, found the mother's conduct in misleading the UK High Court about the child's location "inconceivable," and determined that the father's financial stability and educational environment in Noida better served the child's welfare than remaining with grandparents. The Court set visitation rights for the mother and grandparents and directed guardianship proceedings under the Guardians and Wards Act, 1890.
