Koshy Jacob vs Union of India & Ors

Bench: 2 — Unspecified, Unspecified

In Brief

An advocate filed a petition seeking implementation of Court guidelines on compensation for damage caused during agitations and strikes. The petitioner was delayed from reaching home after hospital discharge due to an ongoing strike. The Court had previously recommended statutory amendments to the Prevention of Damage to Public Property Act, 1984 to fix accountability of protest organisers and provide victim compensation. Eight years later, no law had been enacted. The Court held that while it cannot mandate legislation, it expects the Union of India to enact the proposed amendments within a reasonable time. Until then, previous guidelines remain operative, and the petitioner may pursue individual remedies through appropriate forums."
