Kunti Kumari was convicted of insulting and abusing Amita Tudu, a Scheduled Caste woman and head of a village school committee, using caste slurs and derogatory language about her community. The trial court sentenced her to imprisonment; the high court upheld the conviction but reduced the sentence. The Supreme Court affirmed the conviction under Indian Penal Code Section 504 but exercised its discretion under the Probation of Offenders Act to release her after admonition instead of imposing imprisonment, given her lack of prior convictions. The Court also directed that Rs. 10,000/- deposited with it be transferred to the complainant.
