KUSUM LATA SHARMA vs ARVIND SINGH

Bench: 2 — Dinesh Maheshwari, Sanjay Kumar

In Brief

A widow landlord with her joint family (brother-in-law, his wife, and three children) sought eviction of tenants from a residential property in Delhi under Section 14(1)(e) of the Delhi Rent Control Act, 1958, on grounds of bona fide requirement. The Rent Controller granted eviction. The High Court reversed the decision, holding the landlord had misdescribed the property and misled the court. The Supreme Court held the High Court exceeded its limited revision powers under Section 25-B(8), and the property description was sufficiently clear from pleadings, site-plan, and evidence. The Court restored the eviction orders, allowing tenants time to vacate until 31.12.2023 upon payment of arrear rent.
