In Brief
Lal Bahadur Gautam challenged his termination from a university position. An earlier termination order was set aside by the Vice-Chancellor for violating Section 35(2) of the Uttar Pradesh State Universities Act, 1973 and University Regulations. The management then conducted departmental proceedings and issued a fresh termination order. The Supreme Court held that this fresh order also violated the same statutory and regulatory provisions. The Court set aside the termination and ordered the appellant's reinstatement, holding that strict compliance with statutory procedures is mandatory in termination matters.
